1. Acceptance of Terms
By accessing or using BoddByTodd — including the website, mobile app, client portal, or any related services (collectively, "the Service") — you agree to be bound by these Terms of Service. If you disagree with any part of these terms, do not use the Service.
You must be 18 years of age or older to use this platform. By using the Service, you represent and warrant that you are at least 18 years old.
2. Description of Service
BoddByTodd provides AI-assisted personalized fitness programming, macro and workout tracking, water intake tracking, and access to a dedicated fitness coaching platform. Todd Johnson is a licensed kinesiologist who oversees the coaching methodology.
This is a fitness service, not a medical service. See Section 3 for the full health disclaimer.
3. NOT MEDICAL ADVICE — Health Disclaimer
BoddByTodd is not a licensed medical provider, healthcare facility, or health insurance provider. Todd Johnson is a licensed kinesiologist — not a physician, physical therapist, registered dietitian, or licensed healthcare provider of any kind.
Nothing on this platform constitutes medical advice, medical diagnosis, or treatment of any kind. All fitness programs, nutrition guidance, macro targets, and workout recommendations are general fitness information only — not personalized medical advice.
You should consult a qualified physician before beginning any exercise or nutrition program — especially if you have or suspect you have a pre-existing medical condition, orthopedic injury, cardiovascular condition, metabolic disorder, or if you have been sedentary for more than 6 months.
By using this Service, you acknowledge that you understand these limitations and that you participate in all fitness activities entirely at your own risk.
4. Pricing and Payment
- •Program access ($199 one-time): A single payment of $199 grants you 13 weeks of AI coaching access, including your personalized program and full use of the tracking app.
- •Continuing AI access ($9.99/month): After your 13-week period, you may continue with an optional monthly subscription for continued AI-powered tracking features.
- •All payments are processed securely by Stripe, Inc.
- •Prices are subject to change with 30 days' advance notice by email to active subscribers. Any price change will not affect your current billing period.
5. Refund Policy
Program Fee — $199
The $199 program fee is non-refundable once your personalized program has been generated and delivered. This is because your program is a custom digital product created specifically for you using your individual data, and its creation cannot be undone.
Exception: If a technical failure on our end prevents your program from being generated and delivered, you are entitled to a full refund. Contact coach@boddbytodd.com within 7 days of your purchase.
Monthly Subscription — $9.99/month
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period — you retain full access until that date. No partial-month refunds are issued.
If you are charged after a confirmed cancellation, contact coach@boddbytodd.com within 7 days and we will issue a full refund of the erroneous charge.
6. Cancellation
You can cancel your monthly subscription at any time directly from your account settings page — no need to contact us. In accordance with FTC guidelines, cancellation must be as easy as sign-up: it is available directly within your account without requiring you to call anyone, send an email, or complete any additional steps.
Cancellation is effective at the end of your current billing period. You will retain full access to the Service until that date.
7. Intellectual Property
Your personal intake data and health information remain yours. The AI-generated fitness program created from your data is licensed to you for personal use only. You may not resell, redistribute, publish commercially, or share it with third parties who have not paid for their own program.
BoddByTodd retains all rights to the platform, application, coaching methodology, branding, and underlying technology. You may not copy, scrape, reverse-engineer, or reproduce any part of the Service.
8. Acceptable Use
You agree not to:
- • Share your account credentials or program access with other individuals.
- • Use the platform for commercial purposes without our written permission.
- • Attempt to reverse-engineer, decompile, or extract the AI system or proprietary code.
- • Submit false or intentionally misleading health information.
- • Use the Service in any way that violates applicable law or regulation.
9. Limitation of Liability
To the maximum extent permitted by applicable California law, BoddByTodd's total liability to you for any claim arising from or related to use of this Service — including claims based on contract, tort, negligence, strict liability, or otherwise — shall not exceed the total amount you paid to BoddByTodd in the 12 months immediately preceding the claim.
BoddByTodd is not liable for indirect, incidental, consequential, punitive, or special damages of any kind, including but not limited to: loss of profits, loss of data, personal injury arising from exercise activities, or injury arising from use of the program without prior medical clearance.
10. Disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration in Riverside County, California, in accordance with the American Arbitration Association's Consumer Arbitration Rules.
Either party may seek emergency injunctive relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Class action waiver: You agree to resolve disputes with BoddByTodd on an individual basis only, and not as part of any class, collective, or representative action.
11. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify registered users by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes.
